1. Agreement to Terms

By accessing or using WinMax Optimizer ("the Software"), operated by MD SOFTWARE LLC FZ ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our Software.

2. Description of Service

WinMax Optimizer is a Windows performance optimization tool designed to improve system performance, reduce latency, and enhance gaming FPS. The Software modifies certain Windows settings and configurations to achieve these optimizations.

3. License and Usage

• Free Version: We offer a free version with limited features for personal, non-commercial use.
• Pro Version: The Pro version requires a paid subscription based on duration (daily pricing). Your license is valid for the duration purchased.
• You may not redistribute, resell, sublicense, or share your license with others.
• You may not reverse engineer, decompile, or modify the Software.
• One license is valid for one user on up to 3 personal devices.

4. Payment Terms

• Pro version pricing is $0.94 USD per day.
• All payments are processed securely through our payment processor (Komerza/Stripe).
• Prices are subject to change with 30 days notice to existing subscribers.
• All fees are exclusive of taxes, which may be added where applicable.

5. User Responsibilities

You agree to:

• Use the Software only for lawful purposes and in accordance with these Terms.
• Create system backups before using optimization features.
• Not use the Software to harm, exploit, or compromise other systems.
• Not use the Software in any way that violates applicable laws or regulations.

6. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF HARMFUL COMPONENTS. USE OF THE SOFTWARE IS AT YOUR OWN RISK.

While we design our optimizations to be safe and reversible, modifying system settings carries inherent risks. We recommend creating system restore points before applying optimizations.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MD SOFTWARE LLC FZ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, SYSTEM DAMAGE, OR LOSS OF PROFITS, ARISING FROM YOUR USE OF THE SOFTWARE.

Our total liability shall not exceed the amount you paid for the Software in the 12 months preceding the claim.

8. Intellectual Property

All content, features, and functionality of the Software, including but not limited to text, graphics, logos, and code, are owned by MD SOFTWARE LLC FZ and are protected by international copyright, trademark, and other intellectual property laws.

9. Termination

We may terminate or suspend your access to the Software immediately, without prior notice, for any breach of these Terms. Upon termination, your license to use the Software will immediately cease.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Dubai, UAE.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on our website with a new "Last updated" date. Continued use of the Software after changes constitutes acceptance of the modified Terms.
